DayStruck Terms of Service

DayStruck is operated by GRAXION LLC ("GRAXION," "we," "us"). By creating an account or using DayStruck, you agree to these terms and to the DayStruck EULA / Community & Safety Terms, which are part of these terms.

1. What DayStruck is

DayStruck pairs you with one other adult in the United States for a single 24-hour day of conversation inside the app. When the day ends, the connection dissolves unless both people independently choose Keep. DayStruck has no feed, no followers, and no public profiles.

Matching depends on who else is in the pool that day. We honor place wishes and shared threads in order, but a match is never guaranteed.

2. Eligibility

• You must be 18 or older. We verify date of birth at signup; under-18 accounts are not created.
• DayStruck launches in the United States only.
• One account per person. No accounts for anyone else, and no automated or bot accounts.

3. Your account

• Keep your sign-in credentials to yourself; you are responsible for activity on your account.
• Use a display name — a real name is never required.
• You may delete your account at any time in the app.
• The current free allowance is 2 days per week. We may change allowances or add optional paid extras later; any change will be announced in the app before it applies. DayStruck carries no advertising.

4. Conduct

You agree to the conduct rules in the EULA / Community & Safety Terms, including zero tolerance for objectionable content and abusive behavior. In short: be decent to your friend for today, respect a block instantly and permanently, and never share another person's precise location, contact details, or content outside DayStruck.

5. Reports, blocks, and moderation

• Report: Filing a report ends the day immediately and freezes the record for review. We review and act on reports within 24 hours.
• Block: Blocking works at any moment, including mid-conversation and mid-call. Blocked pairs are never matched again.
• Consequences: Depending on severity — warning, suspension, or permanent ban. Threats, anything involving a minor, and unsolicited explicit content result in immediate suspension pending review. Repeated no-shows (3 within 30 days) pause matching for 7 days.

6. The Keep and your content

• A Keep happens only when both people press it independently. Anything else dissolves, including the conversation, as described in the Privacy Policy.
• You keep ownership of what you send. You give GRAXION a limited license to store, transmit, and display your content solely to operate DayStruck (delivering it to your friend for today, safety review, and the dissolution and retention rules in the Privacy Policy).
• Your keepsake is yours: the card and your own notes. It never contains the other person's messages or photos.

7. Safety — read this part

• GRAXION does not run background checks and does not verify identity beyond the signup age gate and account email. Treat your friend for today as what they are: a stranger you just met.
• Never share your precise location, home address, financial information, or passwords. Keep conversations inside DayStruck.
• If someone makes you uncomfortable, block and report. If you believe a crime has occurred, contact local law enforcement.

8. Service availability

DayStruck is provided "as is." We may change, pause, or discontinue features. The 24-hour window, matching, and video are best-effort services that depend on pool size, connectivity, and providers.

9. Termination

You may stop using DayStruck and delete your account at any time. We may suspend or terminate accounts that violate these terms or the EULA, or where required for safety or by law.

10. Liability

To the maximum extent allowed by law, GRAXION's total liability arising from DayStruck is limited to the greater of $50 or what you paid GRAXION for DayStruck in the prior 12 months, and GRAXION is not liable for indirect or consequential damages. Nothing in these terms limits liability that cannot be limited under applicable law.

11. Other users and offline interactions

DayStruck introduces you to other users; it does not control them. GRAXION is not responsible for the conduct of any user, on or off the app, and does not guarantee any user's identity, statements, or intentions. If you choose to communicate outside DayStruck or to meet another user in person, you do so entirely at your own risk. Nothing in this section limits liability that cannot be limited under applicable law.

12. Indemnification

To the maximum extent allowed by law, you agree to indemnify and hold harmless GRAXION LLC and its member from claims, damages, and reasonable legal costs arising from your use of DayStruck, your content, or your violation of these terms or the EULA / Community & Safety Terms, except where the claim arises from GRAXION's own gross negligence or willful misconduct.

13. Arbitration and class action waiver

Any dispute arising from DayStruck or these terms will be resolved by binding individual arbitration in Florida under Florida law, rather than in court, except that either party may bring an individual claim in small claims court, and GRAXION may seek injunctive relief in court for misuse of the service. You and GRAXION waive any right to participate in a class action, class arbitration, or representative proceeding, and any right to a jury trial, to the maximum extent allowed by law. If this arbitration section is held unenforceable as to a dispute, that dispute will be resolved in the state or federal courts located in Florida.

14. Governing law

These terms are governed by the laws of the State of Florida, USA.

15. Changes and contact

We will announce meaningful changes to these terms in the app or on this page before they take effect.
